Trakker Terms of Service

These Terms of Service ("Terms") govern your use of Trakker (the "Service"), operated by Heimer ("Trakker," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 16 years old to use Trakker. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and, where applicable, to enter into a paid subscription.
2. Your Account
You're responsible for maintaining the security of your account and for all activity under it. Notify us promptly if you believe your account has been compromised. You agree to provide accurate information when creating your account.
3. The Service
Trakker aggregates internship and new-grad job postings from publicly available company career pages and applicant tracking systems, tracks recruiting events, and provides a resume-editing tool with AI-assisted bullet rewriting.
Job listings. We do our best to keep listings accurate and current, but we do not control the companies posting them and cannot guarantee that a listing is still open, accurately described, or that applying will result in any particular outcome. Always verify details directly with the employer before applying.
AI-generated content. Trakker uses third-party AI language models in two features: restructuring an imported resume into an editable document, and generating suggested bullet rewrites. Both are disclosed in more detail in our Privacy Policy. You are solely responsible for reviewing, editing, and verifying the accuracy of any AI-processed or AI-generated content before using it, including on a resume submitted to a real employer. Trakker does not guarantee the accuracy, truthfulness, or effectiveness of AI-generated suggestions or AI-restructured imports, and you should never let either feature introduce false or misleading claims into your resume.
Applications tracker and spreadsheet import.Trakker lets you log and track your own job applications, and optionally import an existing spreadsheet of tracked applications. When you import a spreadsheet, you represent that you have the right to upload it and that doing so does not violate any confidentiality obligation or another person's privacy. As described in our Privacy Policy, a small structural sample of an imported file is sent to a third-party AI provider solely to identify its columns and normalize status labels — you review and confirm every row before anything is saved to your tracker.
4. Subscriptions and Billing
Trakker offers a free tier and paid Core and Pro access. Core is billed weekly; Pro is billed either monthly or per three-month season, as described on our pricing page. Prices and promotional offers are as displayed at the time of purchase.
Paid subscriptions are billed in advance and, unless stated otherwise, are non-refundable for the current billing period once charged. You can cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and you will retain paid-tier access until then.
We may change our prices with advance notice; changes will not apply to a billing period you've already paid for.
Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms as they apply to processing your payment.
5. Acceptable Use
You agree not to: use the Service for any unlawful purpose; attempt to scrape, reverse-engineer, or systematically extract data from the Service beyond normal use; interfere with or disrupt the Service's operation; misrepresent your identity or impersonate another person or entity; or upload a resume, spreadsheet, or other content containing another person's personal information without their consent.
6. Event Submissions
The Service lets you submit recruiting events (for example, a company info session and its registration link) for possible publication to other users. By submitting an event, you represent and warrant that: the event is publicly advertised and its registration is open to the general public or to students generally; the registration link is not a private, personalized, tokenized, or invitation-only link; the information you submit is accurate to the best of your knowledge; and you have the right to share it, and doing so does not violate any confidentiality obligation, platform terms, or other agreement you are subject to.
Submissions are reviewed before publication, and we may edit for formatting, reject, or remove any submission at any time for any reason, without notice. Review does not guarantee accuracy, and published events remain the responsibility of the submitter and the hosting company; we do not organize, endorse, or verify the events themselves. If you believe an event was published that should not be public, contact us at admin@trakkerhq.com and we will review and, where appropriate, promptly remove it.
You agree to indemnify and hold harmless Trakker, Heimer, and their founders from any claims, damages, liabilities, and reasonable costs (including attorneys' fees) arising out of a breach of the representations above in connection with an event you submitted, to the extent caused by that breach.
7. Intellectual Property
Our content.The Service itself, including its design, code, and features, is owned by Heimer and protected by applicable intellectual property laws. These Terms don't grant you any rights to our trademarks, branding, or underlying technology beyond what's needed to use the Service as intended.
Your content. You retain ownership of the resume content, application- tracking data, and other information you input into Trakker. By using the Service, you grant us a limited license to store, process, and display that content solely as needed to operate the Service for you (including sending resume or spreadsheet data to a third-party AI provider when you use the import or rewrite features, as described in our Privacy Policy).
Job listing data and trademarks. Job postings displayed on the Service are aggregated from publicly available employer career pages and applicant tracking systems. Company names, logos, and posting content belong to their respective owners; our display of them is limited to indexing and presenting publicly posted information for your convenience, and does not imply any affiliation with, sponsorship by, or endorsement from the companies listed.
8. Copyright Complaints
If you believe material on the Service infringes your copyright, send a notice to admin@trakkerhq.com including: (1) identification of the copyrighted work; (2) identification of the material you claim is infringing and where it appears on the Service; (3) your contact information; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, made under penalty of perjury, that the notice is accurate and that you are authorized to act on the copyright owner's behalf; and (6) your physical or electronic signature. We will respond to valid notices in accordance with applicable law.
9. Third-Party Services
Trakker relies on third-party providers, including Clerk (authentication), AWS (hosting and email), Stripe (payments), and one or more AI language model providers (for the rewriting feature). We are not responsible for outages, errors, or issues originating from these third-party services, though we'll make reasonable efforts to address any disruption to the Service they cause.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that job listings will be accurate or lead to employment.
11. Limitation of Liability
To the maximum extent permitted by law, Trakker and its founders will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim arose.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or engage in conduct that harms the Service or other users.
13. Changes to These Terms
We may update these Terms from time to time. We'll post the updated version here with a new "Last updated" date, and for material changes, we'll make reasonable efforts to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-laws principles.
